Rental Terms & Conditions
1. Parties
As used in this Policy, the term “Guest” refers to you and anyone in your party who is a permitted guest pursuant to a reservation for lodging made by you. The term “DHR” refers to Dugan Hollow Retreats LLC, a domestic limited liability company having its principal offices in Wayne County, Indiana. DHR is the owner and operator of Dugan Hollow Retreats.
2. Scope
Unless otherwise specified in writing by DHR, these terms and conditions shall apply to every interaction between Guest and DHR before, during and after Guest’s stay at Dugan Hollow Retreats.
3. Reservations and Payments
Reservations are confirmed only upon payment by Guest of all charges and taxes associated with such reservation in accordance with the following schedule:
Reservations for (2) nights or high demand dates (specified at time of booking): Paid in full at time of booking
Reservations for (3) nights or more: 50 % deposit at time of booking, balance paid in full no later than (14) days prior to stay
Unless otherwise specified in writing by DHR, the payment methods specified on DHR’s website shall be the exclusive means of payment for reservations.
4. Cancellations and Refunds
Except as otherwise specified at the time of booking or as agreed to in writing by DHR, Guest shall have the right to cancel and receive a refund for any reservation in accordance with the following schedule:
100 % refund for cancellations made at least (14) days prior to stay
50 % refund for cancellations made less than (14) days but at least (7) days prior to stay
NO refund for cancellations made less than (7) days prior to stay or for high demand dates
(specified at time of booking)
5. Limitation of Liability for DHR Cancellations
In the event the premises reserved by Guest becomes unavailable for Guest’s use due to double-booking, damage to the premises, or otherwise, DHR will immediately contact Guest to advise of the same and shall provide Guest the option of transferring Guest’s reservation to another date(s) and/or another available unit or receiving a full refund of all amounts paid by Guest for such reservation. In no event shall DHR’s liability to Guest in such circumstances exceed the amounts actually paid by Guest for such reservation nor shall DHR be liable to Guest for any incidental, consequential or other such costs.
6. Check-In and Check-Out Times and Procedures
Unless otherwise agreed to in writing by DHR, check-in time for all units shall be between 4:00 p.m. and 9:00 p.m. Eastern Daylight Time (EDT). Check-out time shall be at 11:00 a.m. EDT. Unless otherwise agreed, check-in and check-out will be contactless. DHR will provide check-in and check-out instructions by email and/or text to Guest, including keyless entry code(s), wifi passwords and other information.
7. Guest’s Use of Facilities
In consideration of Guest’s payment to DHR of all agreed-upon charges and taxes associated with Guest’s reservation and subject to Guest’s compliance with this Policy, Guest shall have the right to use, occupy and enjoy the premises so reserved (i.e., a suite, cabin or combination) as well as designated parking and common areas. In no event shall Guest have the right to use or to trespass upon any other premises of DHR, including but not limited to, other guest premises, non-public buildings and spaces, unmarked trails and any other premises.
8. House Rules
Guest agrees to abide by all House Rules while on DHR premises, which House Rules are available on this website and are herein specifically incorporated by reference.
9. No Smoking or Vaping
Smoking and vaping are prohibited inside the suites and the cabin. Smoking is permitted outside all units and ashtrays are provided for such purpose. In the event Guest violates this policy, Guest will be charged and agrees to pay an additional cleaning fee in the amount of $500.00.
10. Pets
Pets are not permitted inside or in the vicinity of the suites. Well-behaved and house-broken dogs are permitted in the cabin upon prior approval of DHR, provided such dog(s) are not allowed to disturb other guests and are crated inside the cabin when Guest is away.
11. Assumption of Risk and Limitation of Liability
Guest agrees and acknowledges that, due to the natural surroundings of Dugan Hollow Retreats, there are numerous natural risks and hazards which cannot be completely mitigated by DHR despite the exercise of reasonable care by DHR. For purposes of illustration but not by way of limitation, these risks and hazards include the risk of bodily injury and/or death by fall or drowning in non-public areas such as the creek, waterfalls and other unmarked and non-public areas, encounters with wildlife (deer, fox, coyotes, raccoons, bats, flying squirrels, mice, etc.) and/or intrusion of the same into Guest’s living quarters, insect bites and allergic reactions to the same, and poisonous plants, trees, and shrubs. By coming onto, using and occupying DHR premises, Guest assumes all such risks and agrees to defend, indemnify and hold harmless DHR from all claims of bodily injury and/or death and/or damage to personal property arising therefrom, except to the extent the same are caused by the gross negligence or willful misconduct of DHR.
12. Safety and Emergency Procedures
Smoke alarms and fire extinguishers are located in every suite and in the cabin. Guest agrees not to tamper with, disable or misuse such devices. In the event of a fire, natural disaster, medical, weather or other emergency, Guest should immediately contact emergency responders by calling 911. Once the Guest is safe, the Guest or his representative should contact DHR to report the emergency.
13. Lost or Stolen Items
Guest agrees to exercise reasonable care to protect and preserve from loss or damage all of Guest’s personal property while Guest is on DHR premises. In the event Guest loses or misplaces an item, Guest shall notify DHR in a timely manner. If DHR is able to locate such item, DHR will offer to return such item to Guest at Guest’s expense. If Guest believes an item has been stolen, Guest shall report the same to DHR and DHR will notify the appropriate authorities to enable DHR and/or Guest to file a report.
14. Quiet Hours and Respect for Other Guests
At all times, Guest shall conduct himself on DHR premises in such a manner so as not unreasonably to interfere with the rights to quiet enjoyment of the premises by other guests of DHR. At a minimum, this responsibility shall include refraining from loud activities between the hours of 10:00 p.m. and 7:00 a.m., including outdoor gatherings and excessive movement of automobiles and other vehicles.
15. Damage to DHR premises
In the event Guest causes damage to DHR premises either directly or indirectly, Guest agrees to pay for such damage immediately upon presentment by DHR of an itemized invoice for the same. In the event Guest fails or refuses to pay such invoice within (7) days of presentment, DHR may, at its option, charge the amount of such invoice to Guest using the method of payment Guest used at the time of booking or bring suit against Guest to recover all amounts owing to DHR plus the costs of collection, including court costs and reasonable attorney’s fees.
16. Dispute Resolution – Arbitration
In the event of a dispute between Guest and DHR, whether arising out of this Policy or otherwise, the parties agree to submit the same to binding arbitration. Such arbitration shall be conducted by Arbitration Resolution Services, Inc. (ARS) and the parties shall be bound by any and all rules of ARS and any award/decision rendered.
17. Privacy
DHR shall use its best efforts to protect and preserve the privacy of any personal information obtained from Guest, whether during the booking process or otherwise, and shall not knowingly use, transmit or share such information with anyone, including other guests of DHR, without the written consent of Guest, provided however, that if Guest agrees to receive marketing and advertising emails from DHR at the time of booking, such permission shall continue unless and until subsequently revoked by Guest.
